ADGE Hotel Competition – Terms & Conditions

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.

 

  1. In order to be eligible to enter the promotion, the individual must be an “Eligible Entrant”. An Eligible Entrant is an Australian resident aged at least 18 who is a Facebook or Instagram user and is not (a) an employee of the Promoter or agencies associated with the promotion nor (b) an immediate family member of an employee as specified in clause 2(a).

 

  1. To enter the Promotion Eligible Entrants must (a) visit and “like” the ADGE Hotel Facebook Page at https://www.facebook.com/AdgeBoutiqueApartmentHotel/ or our Instagram Page at https://www.instagram.com/adgehotel/ (“Promotional Website”); (b) Take a photo of your favourite ADGE moment and share on Facebook or Instagram; (c) ADGE Hotel must be tagged in the image; this can be via a tag, a check in or a mention in the comment. The tag must link up to our accounts as above; and (d) the hashtag #WeLoveADGE must be used.

 

  1. The Promotion commences at 1230pm EST on Friday 24th June 2016 and ends at 12:30pm EST on Friday 19th August 2016 (“Promotional Period”). Only those entries that are received during the Promotional Period will be considered.

 

  1. Each Eligible Entrant may submit one Entry only.

 

  1. The prize consists of a $400 Westfield Voucher.

 

  1. In entering the promotion, participants warrant to ADGE Hotel that: (a) they have the rights to the content of their Entry and that it does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal, confidentiality or proprietary rights; (b) the Entry has not been submitted for any other competition, promotion or any other commercial use; (c) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

 

  1. Each Eligible Participant grants the Promoter a non-exclusive, royalty-free, worldwide licence without charge to use, reproduce, publish and display any or all of their Entry or Entries. or Entries solely for the purpose of promoting this Promotion. Cambridge Hotel reserves the right to use the entries for promotional purposes.

 

  1. Judging will take place once the Promotional Period has ended. Entries will be judged by a judging panel selected by the Promoter on its literary, originality and creative merit. The judging panel may select additional reserve Winners that they determine to be the next best and record them in order, in the event that an invalid entry or ineligible entrant is selected as the Winner, in which case the first reserve Winner will be deemed the Winner and so on as needed.

 

  1. The Winner will be advised by an email to the email address they have provided and the winning Entry will be published on Facebook and Instagram by Friday 26th August 2016.

 

  1. The Prize money will be either be (a) collected by the winner from ADGE Hotel, 222 Riley St, Surry Hills, NSW 2010, or (c) delivered to a nominated postal address, by Australian post.

 

  1. The Promoter’s decision is final and no correspondence will be entered into.

 

  1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, at its sole discretion, to determine the identity of the entrant. The Promoter reserves the right to request an individual establish that they are eligible, and may also request that they sign a statutory declaration confirming compliance with these terms and conditions. The Promoter reserves the right to request Eligible Entrants provide proof of identity, residency, and age. Proof considered suitable for verification is at the discretion of the Promoter.

 

  1. The Promoter reserves the right, at any time, disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

 

  1. The Promoter reserves the right to publish the Winner’s name, Entry and town.

 

  1. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users. All entries are subject to the www.facebook.com website prevailing terms and conditions of use (available at and linked to http://www.facebook.com/promotions_guidelines.php). The Promoter may delete any content posted on its site (including, but not limited to the ADGE Hotel Facebook Page) in accordance with the Promoter’s prevailing terms and conditions of use of its site. Any entries that are removed by the Promoter will not be considered Eligible Entries for the purposes of this promotion. The Promoter is not responsible and excludes all liability (to the greatest extent allowable by law) for the content of any entries submitted for the purposes of this promotion (including but not limited to any illegal, incorrect or inaccurate content and third party advertising).

 

  1. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants acknowledge that they are providing their entry information to the Promoter and not to Facebook or Instagram.  Entrants release and indemnify Facebook from any liability solely occurring as a result of this Promotion. The information so provided will only be used for the purposes of the Promotion and as detailed in these Terms and Conditions. Facebook is not responsible for providing any information regarding questions, comments or complaints regarding the Promotion. Please direct all correspondence to the Promoter. Any linking to Facebook or its associated applications within this Promotion is provided for the convenience of participants. Any link or mention of Facebook is not to be taken as an endorsement or approval of their Terms of Use by the Promoter.

 

  1. Incomplete, indecipherable, or illegible entries will be deemed invalid.

 

  1. Notwithstanding clause 20, errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into.

 

  1. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification.

 

  1. The Prize is not transferable or exchangeable and cannot be taken as cash.

 

  1. Any cost associated with accessing the Promotional Website is the entrant's responsibility and is dependent on the telecommunications and internet service provider used.

 

  1. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. The Promoter reserves the right to determine this in its absolute discretion.

 

  1. Except for any liability that cannot be excluded by law, including but not limited to the Australian consumer law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, photograph or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. For the avoidance of doubt, nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under Australian consumer law.

 

  1. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter.

 

  1. By entering this competition entrants agree to receive marketing and general information from the Promoter via the ADGE Hotel Facebook page.

 

  1. These terms and conditions are governed by the non-exclusive laws of Australia and come under the non-exclusive jurisdiction of the Australian courts.

 

  1. The Promoter is ADGE Hotel of 222 Riley Street, Sydney, NSW, 2010.
